What should I definitely do in my divorce?

When it comes to divorcing from your spouse in New York, there are a few things that you should definitely do. Failing to do these things could result in a longer, more expensive and more psychologically destructive divorce process. Since numerous spouses make the fatal mistake of not doing these things -- and suffer the consequences -- be sure to look over this list to ensure you're either already doing them, or will plan to do them once your divorce is underway.

Cooperate and be reasonable. Many spouses fall into a contentious battle of disagreeing with each other at every corner of their divorce proceedings. Notice if you find yourself falling into this pattern and reverse direction into an attitude of cooperation whenever you can. This will make things much easier in the long run.

Be supportive of your children. Your heart may be filled with emotion and your head could be spinning, but you have to remember to support your children. The breakup is going to be very tough on them regardless of whether they show it. Above all else, never speak ill of your ex-spouse to your children and never make them choose sides.

Work with your spouse to set up temporary child custody arrangements as soon as possible. You may need to consult with your lawyer about this, but be sure to set up temporary parenting plan arrangements, whether they involve shared parenting or a visitation schedule. These arrangements will later be used to form the basis of your permanent custody agreement.

Finally, learn about all of your legal rights and options in terms of asset division, child custody, child support and spousal support. Knowing how the law will look at your case will be beneficial when it comes to negotiating an out of court divorce settlement.
